These Terms and Conditions (“Terms”) govern your use of the Cr8iwitty website (the “Site”) and the purchase of any products from us. By accessing or using our Site and purchasing products, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site or services.

Cr8iwitty is based in Jaipur, Rajasthan, India, and these Terms are governed by the laws of India.

1. About Our Products

Cr8iwitty specializes in creating unique, custom, and artistic 3D printed items. Our product range includes, but is not limited to, 3D action figures, pots/vases, keychains, sculptures, modern art pieces, plastic-made photos, and customized lamps.

Material: All our products are proudly made from biodegradable PLA (Polylactic Acid) plastic. While PLA is durable and eco-friendly, please handle your items with care.
Customization: Many of our products offer customization. We strive to bring your vision to life, but please understand that 3D printing is an additive manufacturing process, and minor variations may occur.
Artistic Interpretation: For custom art pieces or complex designs, our designers will work to interpret your request. We’ll communicate clearly, but final artistic decisions may rest with Cr8iwitty to ensure the best possible print quality and aesthetic.

2. Ordering & Custom Projects

Design Submission: For custom orders, you may be required to submit designs, images, or detailed specifications. By submitting any content, you confirm that you have the necessary rights and permissions to use that content and grant Cr8iwitty a license to use it solely for the purpose of fulfilling your order.
Approval Process: For complex custom orders, we may provide design proofs for your approval. Production will begin only after your final approval.
Right to Refuse: Cr8iwitty reserves the right to refuse any order or custom design that is deemed illegal, offensive, infringes on intellectual property rights, or is otherwise inappropriate at our sole discretion.

3. Pricing & Payment

Currency: All prices displayed on the Site are in Indian Rupees (INR).
Taxes: Prices are inclusive of applicable Goods and Services Tax (GST) where required by Indian law.
Payment Methods: We accept various secure payment methods as indicated on our checkout page. Full payment is required before production begins on any custom order.

4. Shipping & Delivery

Shipping Areas: We ship our products across India. For international inquiries, please contact us directly.
Processing Time: As many of our products are custom-made, please allow for adequate production time in addition to shipping time. Estimated delivery times will be provided at the time of order or inquiry.
Shipping Costs: Shipping costs will be calculated and displayed at checkout, based on your location and the size/weight of your order.
Risk of Loss: Once products have been dispatched from our facility, the risk of loss or damage transfers to you. We are not responsible for delays or issues caused by the shipping carrier, but we will assist you in resolving any delivery problems where possible.

5. Returns, Refunds & Cancellations

Custom Orders: Due to the personalized nature of custom 3D printed items, custom orders are generally non-returnable and non-refundable unless there is a defect in material or workmanship, or the product arrives significantly damaged.
Defective or Damaged Items: please make video while unboxing the product, If your product arrives damaged or is defective, please contact us immediately at cr8iwitty@gmail.com with clear photos and unboxing videos of the damage/defect within 48 hours of delivery. We will assess the issue and offer a replacement or refund at our discretion.
Return Process: If a return is approved, we will provide instructions on how to send the item back to us. Items must be returned in their original condition and packaging.
Cancellations: Orders can only be canceled if production has not yet begun. Once production has started, custom orders cannot be canceled. Please contact us as soon as possible if you wish to cancel an order.

6. Intellectual Property

Cr8iwitty’s Designs: All designs, artwork, product images, and content displayed on the Cr8iwitty website are the intellectual property of Cr8iwitty or our licensed designers. These may not be copied, reproduced, distributed, or used without our express written permission.
Your Designs: For custom orders where you provide the design, you retain the intellectual property rights to your original design. However, by submitting it to us, you grant Cr8iwitty a limited, non-exclusive license to use, reproduce, and print your design solely for the purpose of fulfilling your order.

7. User Conduct

By using our Site, you agree not to:

Use the Site for any unlawful purpose.
Transmit any harmful or disruptive code.
Attempt to gain unauthorized access to our systems or other users’ data.
Upload or submit any content that is illegal, offensive, defamatory, or infringes on the rights of others.

8. Limitation of Liability

To the fullest extent permitted by law, Cr8iwitty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; or (c) any unauthorized access, use, or alteration of your transmissions or content.

9. Disclaimer of Warranties

Our Site and products are provided on an “as is” and “as available” basis. Cr8iwitty makes no warranties, express or implied, regarding the operation of the Site or the information, content, or materials included on the Site. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Privacy Policy

Your privacy is important to us. Please refer to our separate Privacy Policy page for information on how we collect, use, and protect your personal data.

11. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
